Do you need a legal separation to move out?
The answer is no.
Anybody can move out of the marital residence at any time.
However, it’s important to note that what happens during the separation period can be brought up in court, depending on when you file or initiate a legal action.
For example, if you need to leave the marital residence because of high conflict or because it’s affecting the kids, it’s important to handle things carefully. We’d want to see some kind of temporary custody arrangement during that time – meaning, don’t leave without a clear plan for when you’ll see the kids next.
In short, you don’t need a legal separation document to leave the marital home, but it’s best to approach the situation thoughtfully.
