Well, it starts with a husband and wife filling out our joint petition worksheet, which is on our website. This worksheet will walk them through all the different areas that they need to agree to and gives them a little bit of advice on how to agree to it or what to agree to.
They fill this out, they send it to us, and we draft up the documents. It takes us about four to five days to have those documents ready, and we send it back to the husband and wife to review. They make any suggested changes; they give us any edits, maybe we spelled something wrong, and we fix that. But the most important thing is that the terms of the uncontested divorce are agreed to – that they have reached an agreement on the child support, the child custody, the division of assets, who’s going to get the home, how much equity is in the home, and how they’re going to divide it.
Once they’ve done that, and we’ve done the joint petition documents, they sign it. We submit it to the judge. This is where it can take two days for the judge to sign off on it, or it could take two weeks for the judge to sign on it-it just depends on the judge’s schedule. But they’ll review the documents. If they agree that everything is legally binding and everything is sufficient, then the judge will sign off on it, and the decree is done.
I tell clients, you know, expect anywhere between three and four weeks from start to beginning to have their divorce completed if it’s uncontested.
